ALL AMERICAN CHEVROLET OF ODESSA Fraud, Breach of Warranty, Deceptive Trade Practices, Incompetence Odessa Texas!!. On March 26, 2016, I bought a vehicle u2018 a 2018 Jeep Grand Cherokee Sport with 10,435 miles on it u2018 from ALL AMERICAN CHEVROLET, at 5020 John Ben Shepperd Parkway, Odessa, Texas, which is owned and operated by LITHIA MOTORS, INC., in Medford, Oregon. I put down $10,000 cash of my own money as a down payment for this purchase and at this time ALL AMERICAN CHEVROLET also sold me a warranty on the Jeep. ALL AMERICAN CHEVROLET promised me that the warranty they sold me would cover the Jeep u201cagainst any Mechanical or Electrical component failureu201d for a period of five (5) years or until 60,000 miles. As I am a senior citizen who has not had a car payment for many years, it was very important to me that any vehicle I purchased would be very reliable and last for a long time as it would probably be the last car I ever purchase or drive. I expressed this concern to the ALL AMERICAN CHEVROLET salesman before I purchased the Jeep, and he responded by representing that the Jeep would more than meet my expectations, would be u201cvery reliable,u201d and would provide u201ca lot of good use for a long time.u201d The salesman further represented that the Jeep was u201ca good quality vehicle.u201d The salesman’s representations and the warranty sold to me made me feel more comfortable about purchasing the Jeep and putting down $10,000 of my very-hard-earned money, which I had been saving for a long time, as a down payment. Less than 3 full days after I purchased the Jeep, and having driven it less than 100 miles since I left ALL AMERICAN CHEVROLET’s lot, it became quite apparent that significant defects and/or malfunctions existed in the Jeep’s automatic transmission as the transmission repeatedly exhibited erratic, unintended and unsafe behavior, including: 1 erratic/random up-shifts and down-shifts when driving on level (not inclined) roadways at steady speeds and with no change in position of the accelerator pedal; 2 gear changes are repeatedly, in many instances, mechanically harsh or violent; 3 on repeated occasions, when bringing the vehicle to a stop (e.g., when stopping at a red traffic signal light, parking &c.), and the vehicle is almost at a full stop (less than 2 MPH), the transmission then makes a loud grinding noise as the vehicle violently lunges forward at least ten (10) feet, even when excessive pressure is applied to the brake pedal, without touching the accelerator pedal, and with there being no revving of the engine above idle; 4 on repeated occasions, when placing the transmission into u201cpark,u201d the vehicle lunges forward several feet despite my pushing the brake pedal as hard as I can; and 5 on repeated occasions harsh u201cmetal-on-metalu201d clanging noises emanate from the transmission during gear changes while driving, and when the transmission is placed into u201cpark.u201d I went back to ALL AMERICAN CHEVROLET to discuss the above-described problems with the salesman and he essentially told me that this transmission behavior is normal and that the reason the transmission is behaving this way is u201cbecause it’s a 9-speed and doesn’t know which gear it needs to be in.u201d I initially believed him and thought that he knew what he was talking about and that he was being honest with me. About 2 weeks later, the problems in the transmission became much more exaggerated and frequent, so I took the Jeep to LITHIA’s manufacturer-authorized service center, ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA, at 2510 East 8th Street in Odessa, Texas, for repair under the warranty that ALL AMERICAN CHEVROLET sold me. Shortly after getting the Jeep back, I had to make a trip to see family in Ohio. During this trip it became very obvious that the first attempt to repair the Jeep had been a failure as the transmission problems still existed. On the way back from Ohio I began feeling very ill and having severe breathing trouble, so I had to stop in Arkansas at an emergency clinic in Arkansas, where x-rays revealed a spot on my lungs. For several weeks after I returned from Ohio, I was very ill and had to undergo numerous tests and two very dangerous surgeries, which included rotoblation and having 2 stints put in. Because of these things, I was unable to deal with the problems with my Jeep for several weeks. As soon as I was able to do so, I took my Jeep back to LITHIA’s service center, ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA, for a second time to have them repair my vehicle under the warranty that ALL AMERICAN CHEVROLET sold me. ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA had my Jeep for 10 days this time. Less than 5 days after I finally got my Jeep back, it became obvious that this second repair attempt had also been a failure as the transmission problems still existed. I notified ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA of their second failed repair attempt and inquired as to when I could take my Jeep back to them a third time. This inquiry, and several subsequent inquiries over the next week or so, were ignored by ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA. When ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA finally stopped ignoring my inquiries, I took my Jeep back for a third repair attempt. The following day I received news that my nephew in Ohio had passed away, so it became necessary for me to make a second trip to Ohio to attend his funeral. For this reason I picked up my Jeep from ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA before they actually started their third repair attempt. However, I was unable to drive my new Jeep to my nephew’s funeral because ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA advised me, u201cdefinitely do not drive the Jeep to Ohio,u201d and that I u201cshouldn’t be driving the Jeep at allu201d and, u201cthat car is in bad shape.u201d So I had to spend almost $800 to get a commercial flight to attend my nephew’s funeral, which was a severe burden on me as I had just put down $10,000 as a down payment on my Jeep. I notified ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA when I returned from my nephew’s funeral, but ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA did not initially respond. 5 days later, ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA advised me that it was waiting on authorization from Chrysler to replace the transmission valve body in my Jeep and that their mechanic u201cknows what a nightmare this vehicle has been for you.u201d The same day, I went back to ALL AMERICAN CHEVROLET to discuss the numerous problems I was experiencing with the Jeep and with getting it repaired. During this discussion we explored the idea of ALL AMERICAN CHEVROLET taking back the Jeep and getting me into something else. ALL AMERICAN CHEVROLET promised to u201cmake [me] a good dealu201d with which I would u201cbe happyu201d because u201cChevyu201d would soon allow ALL AMERICAN CHEVROLET to make u201cvery good deals on 40 cars.u201d In pursuit of bringing this idea to fruition, a potential deal was formulated involving a 2019 Chevrolet Equinox that I and my Grandson had recently seen on ALL AMERICAN CHEVROLET’s lot. ALL AMERICAN CHEVROLET, however, told me that I had to make sure that the transmission problems in the Jeep, which existed at the time ALL AMERICAN CHEVROLET sold me the Jeep, were fixed before any potential deal could be carried out. The following day I took the Jeep back to ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA to have it complete its third repair attempt. I then went back to ALL AMERICAN CHEVROLET to further discuss the potential deal we had formulated the previous day. At this time I noticed that the aforementioned Chevrolet Equinox that was made an integral part of the potential deal, which my Grandson and I both looked at, was no longer on the lot. Two different employees of ALL AMERICAN CHEVROLET then (1) denied that the Equinox had ever been on the lot, and (2) claimed that they did not know which vehicle I was referring to. ALL AMERICAN CHEVROLET then offered me a very insulting deal on an alternative vehicle, which I declined. I then asked ALL AMERICAN CHEVROLET to just buy back the Jeep from me. ALL AMERICAN CHEVROLET then created and presented me with a worksheet/buy-back proposal containing several financial figures. In essence, ALL AMERICAN CHEVROLET’s proposal was that they would keep my $10,000 cash down payment and buy back my Jeep at $6,000 less than what I paid for it, if I would fix the problems in the transmission that existed when they sold me the Jeep. As any sane person would do, I had to decline this offer. Because this meeting with ALL AMERICAN CHEVROLET was causing me severe anxiety and stress, and because my doctors had recently and very clearly, sternly and repeatedly warned me to avoid stress to the greatest extent possible, I had to end the meeting with ALL AMERICAN CHEVROLET and leave the business. Two days after the aforesaid meeting with ALL AMERICAN CHEVROLET, I picked up my Jeep from ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA after its third attempt to repair my Jeep. It soon became obvious that this third repair attempt had also been a failure, as the transmission in my Jeep still had severe problems and malfunctions. For the following week I notified ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA multiple times that their third repair attempt had been a failure, but ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA ignored these notifications. On October 3, 2019 I was driving the Jeep along southbound Grandview Avenue. As I approached the intersection of Grandview and University Boulevard, I entered Grandview’s the left-turn-lane in order to turn left (east) turn onto Univeristy. I waited in the turn-lane for a moment, for a safe break in the oncoming traffic that was northbound on Grandview. Eventually such a break occurred that would have easily permitted a safe left-hand turn in a properly- working vehicle. However, when I depressed the Jeep’s accelerator pedal to proceed into my intended left-hand turn, the Jeep crept part way through the intended turn and then hesitated/stalled, with a complete lack of acceleration, in the intersection, directly in the path of oncoming traffic. As I u201cpumpedu201d the Jeep’s accelerator pedal in desperation, attempting to make the Jeep move to safety, the oncoming traffic drew dangerously close to the intersection. The drivers of multiple oncoming vehicles were forced to aggressively apply the brakes of their vehicles and/or make evasive maneuvers to avoid hitting me. Just a fraction of a second before one of the oncoming vehicles collided with me, with me helpless and terrified and still desperately pumping the accelerator pedal, the Jeep finally accelerated, albeit with greatly-diminished power, out of the intersection as several drivers of oncoming vehicles honked their vehicles’ horns and made lewd hand gestures in anger. On the same day as the above-described terrifying incident, I notified ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA of the incident and inquired as to when I could bring my Jeep back in for a fourth repair attempt under the warranty that ALL AMERICAN CHEVROLET sold me. ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA ignored this notice and inquiry. For the next couple of week I made repeated inquiries to ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA as to when I could bring my Jeep back in for repair, and ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA has ignored every inquiry. To date, I have never heard from ALL AMERICAN CHRYSLER JEEP DODGE OF ODESSA again. Because of the very stressful and depressing history regarding my Jeep, as above-described, I set out to do some research to discover my options. In the course of this research I found that (1) the problems with my Jeep are common in certain Jeeps, which (2) is widely-known among dealers and service centers, and (3) at the time when ALL AMERICAN CHEVROLET sold me the Jeep and made its representations of quality and reliability regarding the Jeep, it had constructive knowledge of these problems, but did not inform me of such problems. In essence, ALL AMERICAN CHEVROLET induced me to buy my Jeep on false representations, breached the warranty it sold me upon its multiple failures to repair my Jeep and now just flatly ignores my requests to make any further repair attempts. Because I am a senior citizen on a limited income, having just given ALL AMERICAN CHEVROLET a $10,000 cash down payment that I saved up for years, and having just spent almost $800 to attend my nephew’s funeral, which I had to do because I could not drive my Jeep there, I cannot afford to have my new Jeep repaired outside of the warranty that ALL AMERICAN CHEVROLET sold me (and I should not have to do so). Having almost become involved in a serious accident as above-described, I am terrified to drive my Jeep and have had to leave it parked in my garage the last several months while still being contractually liable to make payments on it. ALL AMERICAN CHEVROLET advertises that it is u201cthe fun place to buy.u201d This experience has not been fun for me at all. Not only is it not fun, buying from and dealing with ALL AMERICAN CHEVROLET has caused me unjustified financial burden and severe depression, anxiety and mental anguish to the point that it has physically aggravated the heart problems for which I recently had surgery.
